Brief description of the situation : The International Secretariat has expressed grave concern for the physical and psychological integrity of Bernadinho MAGALHAES, Abilio SOARES, Felipe ALBERTO, Paulo ALBERTO, Alberto (no surname), arrested on 14 July 1996, and Miguel MAIA MAU SOCO, and Pedro BORGES, arrested on 22 July. According to reliable information, all the above-mentioned persons were detained by members of battalion "Lino 700" of the Indonesian armed forces, and they are all from the neighbouring regions of Ermera and Bobonaro. According to the information, it is likely that these arrests are related to the arrest of another 14 people in the Ermera region on 14 and 15 July (these were: Matias da CUNHA,28, Delfonso de DEUS,16, Adolfo MADEIRA,27, Bento MARTINS,27, Helder MARTINS,26, Hermano MARTINS,16, Joao,14, Julio MARTINS,28, Jacinto SOARES,26, Luis TILMA,19, Mateus TILMA,27, Abilio XAVIER,28, and Sebastiao LELO ATI,19, and Joao LELO BELI,29.) The last two persons mentioned are believed to be detained at KORAMIL (military headquarters) in Atsabe, however it is still not known where the other 19 East Timorese are being held. According to the information, reports have been received of the torture in detention of Sebastiao LELO ATI and Joao LELO BELI, which lead us to fear the grave risk of torture for the other detainees. Action requested : Please contact the Indonesian authorities urging them to : i. immediately locate the whereabouts of the detainees and take the necessary measures to guarantee the physical and psychological integrity of all 21 detainees; ii. immediately release all 21 detainees if they are being held without valid charges, or if such charges exist, bring them before a competent and impartial tribunal and guarantee their procedural rights at all times; iii.open an exhaustive and impartial enquiry into the alleged illegal detentions and the practice of torture, identify those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions provided by law; iv. ensure in all circumstances respect for human rights and fundamental freedoms in accordance with national laws and international standards.
