Crime of Aggression

No provision.

The 2007 criminal code of the Central African Republic contained a provision, Article 57, devoted to the crime of aggression, which read:

    "Les juridictions Centrafricaines exerceront leur compétence à l'égard du crime d'agression quand une disposition aura été adoptée conformément aux articles 121 et 123 du Statut de Rome, qui définira ce crime et fixera les conditions de l’exercice de la compétence de la Cour à son égard. Cette disposition devra être compatible avec les dispositions pertinentes de la Charte des Nations Unies."
However, the 2010 criminal code does not contain the said provision.

Non-Aggression Peace Accords:

  • Pact on Security, Stability and Development in the Great Lakes Region. International Conference on the Great Lakes Region, 15 December 2006
    The pact, signed by eleven countries of the Great Lakes Region, aims at providing a legal framework governing relations between its signatories, through additional protocols and programmes of action in the following areas: non-aggression and mutual defence, democracy and good governance, judicial cooperation, prevention and punishment of the crimes of genocide, war crimes and crimes against humanity and all forms of discrimination, struggle against the illegal exploitation of natural resources, specific reconstruction and development zone, prevention and suppression of sexual violence against women and children, protection and assistance to internally displaced persons, property rights and returning persons, management of information and communication. It also establishes follow-up mechanisms comprising the Summit, a Regional Inter-Ministerial Committee and a conference secretariat. [Source: UN Department of Political Affairs].

  • Protocol of Non-aggression and Mutual Defence in the Great Lakes Region. Second Summit of the International Conference on the Great Lakes Region, 30 November 2006.
    This protocol is part of the Pact on security, stability and Development in the Great Lakes Region. It aims at preventing and resolving internal and inter-states armed conflicts within and between member states, and resolving any kind of disputes by peaceful means. For the signing parties, this implies the renunciation of the threat or use of force, non-aggression and mutual defence arrangements, common border security management.   • Dar-es-Salaam Declaration on Peace, Security, Democracy and Development in the Great Lakes Region. International Conference on Peace, Security, Democracy and Development in the Great Lakes Region, First Summit of Heads of State and Government Dar-Es-Salaam, 20 November 2004.
    The parties to this declaration affirm their collective determination to transform the Great Lakes Region into a space of sustainable peace and security. They support all the national peace processes in the region, and commit themselves to strengthening their cooperation in the areas of defence, arms trafficking, DDR, and the struggle against terrorism. They shall promote democracy, good governance and human rights, as well as political participation and gender equality. The parties also commit themselves to cooperate in supporting economic development, especially through regional integration. They shall address the humanitarian problems of the region, especially concerning internally displaced persons, land-mines, child soldiers and HIV/AIDS. A Regional Inter-Ministerial Committee is set up, in order to prepare a second summit of the International Conference of the Great Lakes Region, scheduled in 2005.     Crimes Against Humanity

    Crimes against humanity are defined in Title IV, Chapter II, Article 153, of the Central African Republic Criminal Code of 2010 (see full text of Central African Republic criminal code below):

      CHAPITRE II
      DES AUTRES CRIMES CONTRE L'HUMANITE
      Article 153
      : Constitue un crime contre l'humanité, l'un quelconque des actes ci-après lorsqu'il est commis dans le cadre d'une attaque généralisée ou systématique lancée contre toute population civile et en connaissance de cette attaque :
        - Le meurtre ;
        - L'extermination ;
        - La déportation ou transfert forcé de population ;
        - La réduction en esclavage ;
        - La pratique massive et systématique d'exécutions sommaires ;
        - Les disparitions forcées de personnes ;
        - L'emprisonnement ou autre forme de privation grave de liberté physique en violation des dispositions fondamentales du droit international ;
        - La pratique de la torture et des actes inhumains ;
        - Le viol, l'esclavage sexuel, la prostitution forcée, la grossesse forcée, la stérilisation forcée ou toute autre forme de violence sexuelle de gravité comparable ;
        - La persécution de tout groupe ou de toute collectivité identifiable pour des motifs d'ordre politique, racial, national, ethnique, culturel, religieux ou en fonction d'autres critères universellement reconnus comme inadmissible en droit international, suivant les dispositions du Statut de Rome ;
        - Les crimes d'apartheid ;
        - Tous autres actes inhumains de caractère analogue causant intentionnellement de grandes souffrances ou des atteintes graves à l'intégrité physique ou à la santé physique ou mentale.

    Genocide

    Genocide is defined in Title IV, Chapter I, Article 152, of the Central African Republic Criminal Code of 2010 (see full text of the Central African Republic criminal code below):

      CHAPITRE I
      DU CRIME DE GENOCIDE
      Article 152
      : Sont qualifiées crime de génocide, les violations des dispositions du Statut de Rome de la Cour Pénale Internationale et notamment le fait de commettre ou de faire commettre l'un quelconque des actes ci-après, en exécution d'un plan concerté, dans l'intention de détruire en tout ou en partie, un groupe national, ethnique, racial ou religieux, ou un groupe déterminé à partir de tout critère arbitraire :
        - Le meurtre de membres du groupe ;
        - L'atteinte grave à l'intégrité physique ou psychique des membres du groupe ;
        - La soumission intentionnelle du groupe à des conditions d'existence de nature à entraîner sa destruction totale ou partielle;
        - Les mesures visant à entraver les naissances au sein du groupe ;
        - Le transfert forcé d'enfants du groupe à un autre groupe.
    Article 293 punishes the incitement to commit genocide:
      Art. 293 : Sera puni d'une peine d'emprisonnement de deux à cinq ans et d'une amende de 100.002 à 1.000.000 de francs, quiconque aura fait des déclarations publiques ou des propagandes en faveur de la ségrégation raciale, tribale, ethnique, régionale, du génocide et de tous actes reprouvés par la conscience humaine.

    War Crimes

    War crimes are defined in Title IV, Chapter III, Articles 154 to 157, of the Central African Republic Criminal Code of 2010 (see full text of the Central African Republic criminal code below):

      Art.154 : Aux fins du présent code, on entend par " crime de guerre " : Les infractions graves aux conventions de Genève du 12 août 1949 à savoir, l'un quelconque des actes y mentionnés lorsqu'ils visent des personnes ou des biens protégés par les dispositions desdites conventions.

      Art.155 : Constituent également des crimes de guerre, les autres violations graves des lois et coutumes applicables aux conflits armés internationaux dans le cadre établi du droit international.

      Art.156 : En cas de conflit armé ne présentant pas un caractère international, constituent des crimes de guerre, les violations graves de l'article 3 commun aux quatre Conventions de Genève du 12 août 1949 à savoir l'un quelconque des actes commis à l'encontre de personnes qui ne participent pas directement aux hostilités, y compris les membres de forces armées qui ont déposé les armes et les personnes qui ont été mises hors de combat par maladie, blessure, détention ou par toute autre cause.

      Art.157 : Les dispositions de l'article précédent s'appliquent aussi aux conflits armés qui opposent de manière prolongée sur son territoire, l'Etat Centrafricain à des groupes armés organisés ou des groupes armés organisés entre eux.

    Common provisions to Crimes Against Humanity, Genocide and War Crimes:

    Articles 158 to 162 of the Central African Criminal Code of 06 January 2010 contain common provisions to crimes against humanity, genocide and war crimes:

      Art.158 : Le crime de génocide, les crimes de guerre et les crimes contre l'humanité sont punis de la peine de mort.

      Art.159 : Les personnes physiques coupables des infractions visées au présent chapitre encourent également les peines complémentaires prévues à l'article 24 du présent code.

      Art.160 : Les personnes morales peuvent être déclarées pénalement responsables du crime de génocide, des crimes de guerre, des crimes contre l'humanité, des crimes de terrorisme dans les conditions fixées par l'article 10 du présent code.

      Art.161 : L'auteur ou le complice d'un crime visé par le présent chapitre ne peut être exonéré de sa responsabilité du seul fait qu'elle a accompli un acte prescrit ou autorisé par des dispositions législatives ou réglementaires ou un acte commandé par l'autorité légitime.
      Toutefois, la juridiction tient compte de cette circonstance lorsqu'elle détermine la peine et en fixe le quantum.

      Art.162 : L'action publique relative aux crimes prévus par les sections I, II et III du présent titre ainsi que l'action civile et les peines prononcées sont imprescriptibles.
      Les crimes ci-dessus cités ne peuvent faire l'objet d'amnistie ou de grâce.
      Toute immunité relevant du statut national est inopposable.
    Additionally, article 48 of the Criminal Code of the Central African Republic provides:
      Art. 48: Murder, wounding and beating are justified and not punishable:
        1. When they are prescribed by law and ordered by the legitimate authority;
        2. When there is a state of necessity
      Under no circumstances are the above provisions applicable to the crime of genocide, crimes against humanity or war crimes.

    Jurisdiction

    Article 162 of the Criminal Code of 2010 provides that crimes against humanity, genocide and war crimes are not subject to any statute of limitations and that they cannot be affected by amnesty measures or any immunities.

    According to Article 7(c) of the Criminal Procedure Code of 2010, crimes against humanity, genocide and war crimes are not subject to any statute of limitations:

      Le crime de génocide, les crimes de guerre et les crimes contre l’humanité sont imprescriptibles.
    Additionally, Article 10 of the Criminal Procedure Code of 2010 provides that the non-prescription of these crimes applies to both public and private action that might result from the commission of the said crimes:
      [T]outefois l'imprescriptibilité des crimes de guerre, de génocide et des crimes contre l'humanité s'applique tant à l'action publique qu’à l’action civile pouvant résulter de tels crimes.
    Title XIV (Articles 344 to 363) of the Criminal Procedure Code of 2010 is devoted to the cooperation with the International Criminal Court.

    In addition, Article 72 of the Constitution of Central African Republic states:
      "Treaties or agreements lawfully ratified shall have, upon their publication, an authority superior to that of laws, without prejudice for each agreement or treaty in its application by the other party."
    (The Central African Republic ratified the Rome Statute of the International Criminal Court on 03 October 2001 and, inter alia, is a State party to the four Geneva Conventions of 1949, their two Additional Protocols of 1977, the Convention on the Rights of the Child of 1989 and the Optional Protocol on the involvement of children in armed conflict of 2000).

    International Criminal Court

    Rome Statute of the International Criminal Court: The Central African Republic signed the Rome Statute on 07 December 1999 and deposited its instrument of ratification on 03 October 2001.

    Title XIV (Articles 344 to 363) of the Criminal Procedure Code of 2010 is devoted to the cooperation with the International Criminal Court.
