Crimes Crime of Aggression On 23 September 2016, Chile deposited its instrument of ratification of the amendments to the Rome Statute on the crime of aggression.
On 22 April 2012, the Foreign Affairs committee of the Chamber of Deputies of Chile approved the draft bill submitted by President Sebastian Pinera for the ratification of both Kampala amendments (on aggression and the amendment to article 8 of the Rome Statute). A supplementary report was necessary from the Constitution, Legislation and Justice Committee before approval by the Plenary and before consideration by the Senate. On 31 March 2015 the Senate of Chile approved the ratification of the Kampala Amendments, the Chamber of Deputies having previously given its assent and the Constitutional Tribunal having affirmed the constitutional conformity of the Kampala Amendments. Jurisdiction and Statute of Limitations Article 1 of the Criminal Procedural Code provides as follows:
"Article 1: The courts of the Republic have jurisdiction to try the offenses committed by Chilean and foreign citizens on its territory, unless otherwise provided in specific laws, treaties or international conventions to which Chile is a state party or by the general principles of international law."
Article 6.8 of the "Código Orgánico de Tribunales" (Code on Organization of the Courts), establishes that Chilean jurisdiction shall extend to the crimes and offences committed outside the national territory which are included in treaties entered into between Chile and other nations:

Los tribunales de la República ejercen jurisdicción sobre los chilenos y sobre los extranjeros para el efecto de juzgar los delitos que se cometan en su territorio, salvo los casos exceptuados por leyes especiales, tratados o convenciones internacionales en que Chile es parte o por las reglas generalmente reconocidas del Derecho Internacional".]"Art. 6° Quedan sometidos a la jurisdicción chilena los crímenes y simples delitos perpetrados fuera del territorio de la República que a continuación se indican:

International Criminal Court
Rome Statute of the International Criminal Court: Chile signed the Rome Statute on 11 September 1998 and deposited its instrument of ratification on 29 June 2009.
Upon ratification, Chile made the following notifications under article 87 (1) and (2) of the Rome Statute of the International Criminal Court:"1. In accordance with article 87 (1) (a) of the Statute, the requests for cooperation from the International Criminal Court shall be transmitted through the diplomatic channel to the Ministry of Foreign Affairs of Chile.
2. In accordance with article 87 (2) of the Statute the requests for cooperation from the International Criminal Court and any documents supporting the request shall be in Spanish or be accompanied by a translation into Spanish."

In this case, the Supreme Court admitted the applicability of the 1949 Geneva Conventions to the internal situation in Chile when the alleged crime was committed (forced disappearance starting 19 July 1974). The Court based its decision on the decree of 12 September 1973 in qualifying the internal situation as "a state or time of war," meaning that certain penal provisions were applicable. The Court also referred to common Article 3 and to Articles 146 and 147 of the Fourth Geneva Convention. It recalled national case law relating to the operation of human rights norms in the Chilean legal order and concluded that an application of the 1978 Amnesty Law was not admissible in this case.
