Law No. 4/2002
of 4 April

The present law appears within the scope of the Government's Programme for Peace, made public by the Declaration of 13th March 2002, under which a specific number of measures were announced in order to achieve a durable peace, namely no. 7, which foresees the adoption of an amnesty law for all crimes falling within the scope of the armed conflict;

Recognizing that this measure aims to ensure the necessary legal and political guarantees for the promotion and fulfillment of the process of national reconciliation;

Recognizing the agreements reached between the military leaders of FAA and the military forces of Unita, in connection with the signing of a cease fire accord;

In these terms, as covered in line (h) of article 88 and no. 4 of article 92 of the constitutional law, the National Assembly approves the following:

Article 1

1. Amnesty applies to all crimes against the security of the State committed in the context of the Angolan armed conflict, committed before the entry into force of the present Law.

2. Amnesty applies to all individuals who presented or will present themselves, voluntarily or not, to the Angolan authorities, and to those who present themselves within 45 days from the entry into force of the present Law.

3. Amnesty also applies to all military crimes committed before the date of entry into force of the present Law, except for violent crimes that result in death included in section 3 of article 18 and in section 3 of article 19 of Law 4/94 of 28 January.

4. To come under the intended results of the previous section, those who commit the crime of desertion will benefit up to the 45 day period, counting from the date of the entry into force of the present Law, by presenting themselves to the relevant authorities.

Article 2

Ambiguities and omissions resulting from the interpretation and application of the present Law are resolved by the National Assembly.

Article 3

The present Law becomes effective upon its publication [in the Diário da Republica].
