Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction (Ratification) Laws 37(III) of 2002 and 10(111) of 2008


A LAW TO RATIFY THE CONVENTION ON THE PROHIBITION OF THE USE, STOCKPILING, PRODUCTION AND TRANSFER OF ANTI-PERSONNEL MINES AND ON THEIR DESTRUCTION

The House of Representatives enacts as follows:

1. This Law may be cited as the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and or their Destruction (Ratification) Laws 2002 and 2008.

2. In this Law-

"Convention" means the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction concluded at Oslo, Norway on 18.9.1997 and signed on behalf of the Republic of Cyprus in Ottava, Canada on 3.12.1997, the text of which, in the English original is set out in Part I of the Table and in its Greek translation in Part II of the Table:

Provided that, in case of conflict between the two texts, the text set out in Part I of the Table shall prevail.

3. The Convention, the signature of which has been decided by the Council of Ministers by its Decision No. 54.939, dated 17.1.02, is hereby ratified.

4.-(1) Any person commits an offence, if he-

    (a) uses, in a way, that is not permitted by the Convention, anti-personnel mines; or

    (b) develops or produces anti-personnel mines; or

    (c) acquires or takes part in the acquisition of anything prohibited under the Convention; or

    (d) possesses anything prohibited under the Convention; or

    (e) transfers or takes part in the transportation of anything prohibited under the Convention; or

    (f) assists or encourages or induces another person to commit any of the offences referred to in paragraphs (a) to (e).

(2) Any person who commits an offence pursuant to subsection (1), shall be guilty of an offence and shall be liable on conviction to a term of imprisonment not exceeding fourteen (14) years or to a fine not exceeding two hundred thousand euros (200.000.00 euros) or to both such imprisonment and fine.

5. For the better implementation of the Convention, the Council of Ministers shall have power to make Regulations for regulating any matter which is required or may be prescribed.
