Ministerial Decision No. 244 /2006 concerning the Establishment of National Committee of International Humanitarian Law (IHL)


Minister of Justice and Minister of Awqaf and Islamic Affairs:

Having regard to the constitution, and

Having regard to:

- Law No. 15 for 1979, on the civil service and its bylaws issued on 04.04.1979, and

- Decree issued on January 7th, 1979 on the Ministry of Justice, and

- Letter of Ministry of Foreign Affairs No. 7466 dated March 25th, on the proposal of establishing a national committee concerned with IHL, and chaired by Ministry of Justice, and

- Letters of:

• Ministry of Defense No. 27220010377 dated May 17th 2006,

• Ministry of Foreign Affairs No. 12413 dated May 17th 2006,

• Kuwait University no. 1427-49 dated May 31st 2006,

• Ministry of Information No. 178 dated May 17th 2006,

• Ministry of Interior No. 1678 dated July 3rd 2006, and

• Red Crescent Society, concerning nomination of staff for IHL Committee's membership.

- Pursuant to the Undersecretary's proposal,

- And Pursuant to the requisite of Public Interest

It was decided

Article (1):

A permanent National Committee on IHL shall be established chaired by Dr. Mohammad Abdullah Al-Ansari, Assistant Undersecretary of Legal Affairs and International Relations, and with the membership of:

    1. Dr. Mohammed Abdul Rahman Buzobor, Assistant Undersecretary of Legal Affairs, Ministry of Defense

    2. Advisor/ Ghanem Sager Al-Ghanem, Director of Legal Department, Ministry of Foreign Affairs.

    3. Dr. Rasheed Hamad Al-Enezi, Assistant Professor - International Law's Section - Faculty of Law

    4. Dr. Fayez Abdullah Al Kendari - Legal Advisor at the office of the Assistant Undersecretary of Legal Affairs - Ministry of Information

    5. Colonel Majed Yousif Al Majed, Assistant General Director of General Department of Legal Affairs, Ministry of Interior 6. Mr. Musaed Rashed Al-Enezi, Superintendent of volunteers and Deputy Officer of Relief at Kuwait Red Crescent Society.

Article (2): IHL National Committee shall have the competence to:

    1. Study National Legislations relevant to IHL, and Judicial Provisions pursuant to the obligations resulted from Geneva Conventions of 1949 and their Additional Protocols of 1977, and further IHL tools and charters.

    2. Enhance the implementation of IHL regulations in Kuwait, and coordinate with all the concerned bodies on issues related to the IHL implementation on national level.

    3. Provide recommendations, proposals, and advice on the implementation of IHL to the concerned national bodies and institutions.

    4. Follow-up the implementation of the committee's recommendations.

    5. Enhance cooperation and exchanging experiences with the concerned ministries, governmental agencies and departments, and to coordinate between these bodies in all IHL issues.

    6. Set up plans, Training and Introduction programs, and organizing seminars that will disseminate and develop the knowledge of IHL.

Article (3): Chairman shall select a rapporteur for the committee. The committee may request the assistance of specialists for purposes of carrying out its duties from inside or outside the Ministry; it can also request information from relevant bodies.

Article (4): The committee may publish its reports and proposals in the local or International Media, and to participate in the relevant seminars and conferences.

Article (5) The Committee provides an annual report of its activities and proposals and submits it to the Minister of Justice.

Article (6): A special allowance that is decided and issued by the Minister of Justice shall be disbursed to the members, rapporteur, and the persons who assist the committee in its work.

Article (7): The Undersecretary shall implement this decision, which shall enter into force as of the date of issue.
