on the Slovak Red Cross Society and on the Protection of the Emblem and Name of the Red Cross Society and on the Amendments of Certain Laws

The National Council of the Slovak Republic has adopted the following law:

Section I

FIRST PART
SLOVAK RED CROSS SOCIETY

Status of the Slovak Red Cross Society

Article 1

(1) The Slovak Red Cross is the only national Red Cross Society acting within the entire territory of the Slovak Republic on the basis of the Geneva Conventions and their additional amendment protocols |1| which as an auxiliary organization to public administration authorities in humanitarian fields fulfils the duties set out by international treaties and this law (Article 5 paragraph 1).

(2) The Slovak Red Cross Society is an autonomous legal person/entity |2| with its registered seat in Bratislava.

(3) The Slovak Red Cross Society acts in accordance with the Constitution of the Slovak Republic, constitutional laws, other generally binding legal regulations, Geneva Conventions and their additional amendment protocols, |3| as well as with other international treaties ratified by the Slovak Republic and proclaimed by means established by law.

Article 2

(1) The Slovak Red Cross Society forms an integral part of the International Red Cross and Red Crescent Movement and is a full member of the International Federation of Red Cross and Red Crescent Societies. It acts in accordance with the fundamental principles of the International Red Cross and Red Crescent Movement, Statutes of the International Red Cross and Red Crescent Movement, guidelines and other documents adopted by the International Red Cross and Red Crescent Movement.

(2) The Slovak Red Cross Society shall perform its duties under the Geneva Conventions and their additional amendment protocols |4| and conclusions of conferences of the International Red Cross and Red Crescent Conferences and cooperate with the International Committee of the Red Cross and other national Red Cross and Red Crescent societies. It has the exclusive right to conclude international cooperation treaties with them.

Article 3
Relations between the state and the Slovak Red Cross Society

(1) The Slovak Republic shall recognize and accept the autonomous status of and provide assistance and collaboration to the Slovak Red Cross Society upon the performance of its duties resulting from the Geneva Conventions and their additional amendment protocols |5| as well as upon the performance of other tasks established by law (Article 5 paragraph 1). The Slovak Republic shall financially and otherwise |6| support the activity of the Slovak Red Cross Society under the principles established by this law.

(2) On the basis of special agreements concluded with the Government of the Slovak Republic (hereinafter referred to as "government") or with other state authorities and for certain agreed compensation, the Slovak Red Cross Society may also take on the performance of other duties in the public interest if such duties do not conflict with the Geneva Conventions and their additional amendment protocols |7| and at the same time comply with the principles and the mission of the International Red Cross and Red Crescent Movement.

(3) The government, individual ministries and other central state administration bodies shall cooperate with the Slovak Red Cross Society and immediately supply any information to it that is necessary for its activity. For such purpose, they shall submit draft laws and proposals of other generally binding legal regulations relative to the activity, duties and mission of the Slovak Red Cross Society to be discussed and commented by the Slovak Red Cross Society and shall invite its representatives to the relevant advisory bodies of the government, ministries and other central state administration bodies..

(4) Any details concerning the cooperation, collaboration and mutual relations between the government, ministries and other central state administration bodies and the Slovak Red Cross Society upon performing duties under this law as well as other duties in the public interest shall be established in an agreement on mutual relations and cooperation concluded between the government and the Slovak Red Cross Society. Agreements on mutual relations and cooperation may also be concluded between regional organizations of the Slovak Red Cross Society and local state administration bodies.

Article 4
Relations between municipalities and higher territorial units and the Slovak Red Cross Society

(1) Municipalities and higher territorial units shall provide assistance and collaboration to the Slovak Red Cross Society upon the performance of its duties resulting from the Geneva Conventions and their additional amendment protocols |8| as well as upon the performance of its other tasks established by this law (Article 5 paragraph 1). They shall also financially |9| and otherwise support the activity of the Slovak Red Cross Society and its regional organizations and cooperate with it as well as with its regional organizations. In this connection, municipalities and higher territorial units shall invite the representatives of the Slovak Red Cross Society to parish council commissions and higher territorial unit commissions as well as to other advisory and initiative bodies.

(2) On the basis of special agreements concluded with municipalities and higher territorial units and for certain agreed compensation, the Slovak Red Cross Society and its regional organizations may also participate in the performance of other duties in the public interest that belong to the competence of municipalities and higher territorial units established by special regulations |10| if such duties do not conflict with the Geneva Conventions and their additional amendment protocols |11| and at the same time comply with the principles and the mission of the International Red Cross and Red Crescent Movement.

Article 5
Duties of the Slovak Red Cross Society

(1) In compliance with the Geneva Conventions and their additional amendment protocols and the resolutions of international conferences of the Slovak Red Cross and Red Crescent Movement, the Slovak Red Cross Society shall perform the following essential duties in times of peace as well as in times of war or warfare |12|:

    a) to act as an solely recognized auxiliary organization of military health care facilities and health care units |13| and to be solely authorized to prepare and carry out auxiliary military medical service for which purpose it shall recruit, register, organise and train voluntary medical workers and volunteers of the Slovak Red Cross Society;

    b) to participate in the civil protection of population for which purpose it shall cooperate with state administration authorities at the civil protection department and may provide for medical, emergency and other humanitarian help in case of extraordinary events |14| and emergencies |15|, and on the basis of an agreement with the Ministry of Interior of the Slovak Republic (hereinafter referred to as "ministry of interior") to fulfil other tasks established by special law; |16|

    c) to cooperate in organising, rendering and intervening medical and life-saving help and to organize, render and intervene other humanitarian help in the case of extraordinary events and emergency situations in affected areas also outside the territory of the Slovak Republic on the basis of appeals or impulses made by the relevant state bodies as well as at its sole discretion;

    d) to act as a component part of the integrated rescue system; |17|

    e) to be authorized to carry out training and instruction of the population concerning first-aid treatment under a special regulation |18| based on accreditation from the Ministry of Health of the Slovak Republic (hereinafter referred to as "ministry of health");

    f) to organize and provide for voluntary blood donations and the taking of other blood products for diagnostic and medical purposes on the basis of an agreement with the ministry of health and in collaboration with health care facilities, especially in cooperation with the National Transfusion Service of the Slovak Republic;

    g) to assist the state administration bodies in the area of health care upon securing other health and rescue services,

    h) to provide for social assistance under a special regulation |19| and for humanitarian care in cooperation and on the basis of agreements with the Ministry of Labour, Social Affairs and Family of the Slovak Republic (hereinafter referred to as "ministry of labour") and other state administration bodies in the area social assistance,

    i) to provide for search services under the Geneva Conventions and their additional amendment protocols |20| and relevant international rules under the assistance of the Police Force of the Slovak Republic, state administration bodies, municipalities and higher territorial units which are in this connection obliged to provide assistance and the necessary information to the Slovak Red Cross Society;

    j) to make the population familiar with the fundamental Red Cross principles and the rules of international humanitarian law, to disseminate ideas of peace, peaceful coexistence, mutual respect and understanding among people, nations and states and to participate in organising and performing instruction regarding international humanitarian law on the basis of agreements with universities and higher education institutions |21| and secondary schools |22|;

    k) to award voluntary blood donors with bronze, silver, gold and diamond plaques of prof. MUDr. Ján Jánsky and medals of MUDr. Ján Knazovický; the details of such awards shall be stipulated in the Statutes of the Slovak Red Cross Society (hereinafter referred to as "Statutes");

    l) to award citizens of the Slovak Republic who put their own life at risk when ministering help to another physical person whose life was in imminent danger with the "For Life Saving" medal and to award citizens of the Slovak Republic with other prizes for their lifelong voluntary service to humanity; the details of such awards shall be stipulated by the statutes;

    m) to provide other publicly beneficial services under a special law; |23|

(2) The Slovak Red Cross Society shall ensure the performance of its duties pursuant to paragraph 1 through its employees as well as through volunteers. For the purposes of this law, the performance of duties pursuant to paragraph 1 by a volunteer shall be considered to be an act in the public interest. |24|

Article 6
Organisational structure of the Slovak Red Cross Society

(1) Membership of the Slovak Red Cross Society is voluntary. Any physical or legal person may become a member of the Slovak Red Cross provided that it resides in the territory of the Slovak Republic, agrees with the principles and mission of the International Red Cross and Red Crescent Movement and meets the other conditions stipulated in the statutes.

(2) The basic organisational units of the Slovak Red Cross Society are local organisations that associate themselves into regional organisations. In the scope established by this law (Article 3 paragraph 4 and Article 4 paragraph 2), the regional organisations have legal personality and are authorized to act in their own name and bear sole responsibility from legal relations.

(3) The Slovak Red Cross Society shall act through its bodies which include the President of the Slovak Red Cross Society (hereinafter referred to as the "President"), Secretary General, Supreme Board and Assembly. The supreme body of the Slovak Red Cross Society is the assembly which the supreme board shall convene a minimum of once every four years.

(4) The President shall represent the statutory representative of the Slovak Red Cross Society who shall be elected and withdrawn by the assembly.

(5) In the scope stipulated by the statutes, the general secretary, who is employed by the Slovak Red Cross Society, shall also act as the statutory representative of the Slovak Red Cross Society.

(6) The details regarding the internal organisation of the Slovak Red Cross Society, method of formation, competence and mutual relations of its bodies as well as regarding the rights and obligations of its members and management principles shall be stipulated by the statutes. The statutes as well as amendments of them shall be subject to the approval of the assembly.

Financial management and accounting of the Slovak Red Cross Society

Article 7
Property and receipts of the Slovak Red Cross Society

(1) The Slovak Red Cross Society is authorized to independently manage its property and may also use state property as well as the property of municipalities and higher territorial units under special regulations. |25|

(2) The property of the Slovak Red Cross Society may only be used in compliance with the principles established by this law and the statutes and for the payment of the expenses (costs) of the Slovak Red Cross Society. The sum of expenses (costs) of the Slovak Red Cross Society shall be determined annually in the budget of the Slovak Red Cross Society (Article 9) in an amount necessary to ensure its activity.

(3) The Slovak Red Cross Society shall in particular obtain resources for its activity from membership fees, revenues from its own activity and assets, donations from physical and legal persons, inheritance, public fundraising, |26| contributions from income tax paid by taxpayers, |27| national budget grants, from the state fund budget and from the budgets of higher territorial units and municipalities and from structural funds of the European Union.

(4) The Slovak Republic shall allocate annual grants from the national budget to the Slovak Red Cross Society for the purpose of performing its duties under the Geneva Conventions and their additional amendment protocols |28| as well as other tasks established by this law (Article 5 paragraph 1) pursuant to a special law. |29|

(5) Municipalities and higher territorial units may allocate grants from their budgets to the Slovak Red Cross Society and its regional organisations pursuant to a special law |30| for the purpose of performing its duties under the Geneva Conventions and their additional amendment protocols |31| as well as other tasks established by this law (Article 5 paragraph 1).

(6) The management of resources allocated pursuant to paragraphs 4 and 5 shall follow the provisions of special regulations. |32|

(7) Upon performing its duties pursuant to this law (Article 5 paragraph 1), the Slovak Red Cross Society shall be exempt from tax, customs duty, legal charges and administrative fees in the scope established by special regulations. |33|

(8) Correspondence of the Slovak Red Cross Society under the Geneva Conventions and their additional amendment protocols |34| shall be exempt from postal charges. |35|

Article 8
Business activities of the Slovak Red Cross Society

(1) The Slovak Red Cross Society may only carry out business activities under conditions established by a special regulation |36| and provided that such activity will help its property to be used more efficiently while not endangering the performance of its duties pursuant to Article 5. The subject of such business activities cannot be in conflict with the Geneva Conventions and their additional amendment protocols |37| and the resolutions of the international Red Cross and Red Crescent Movement Conferences. .

(2) The Slovak Red Cross Society cannot take part in the business activities of other persons or entities and cannot enter into contracts on silent partnership.

(3) The receipts from business activities pursuant to paragraph 1 shall be subject to tax liabilities under the valid tax regulations.

(4) The resources of the Slovak Red Cross Society cannot be used to support or finance the activities of political parties and movements.

Article 9
Budget of the Slovak Red Cross Society

(1) The Slovak Red Cross Society shall operate according to a budget approved by the body determined by the statutes.

(2) The budget of the Slovak Red Cross Society shall include all of the budgeted receipts and expenses. It shall be prepared and approved for the relevant calendar year. The budgeted expenses include the membership fees to be paid to the International Committee of the Red Cross, International Federation of Red Cross and Red Crescent Societies and to the Red Cross/European Union Office.

(3) The draft budget shall be submitted by the secretary general for approval to the body pursuant to paragraph 1 no later than one month prior to the beginning of the calendar year for which it is prepared.

Article 10
Accounting of the Slovak Red Cross Society

(1) The Slovak Red Cross Society shall keep its accounts under a special law. |38|

(2) In its accounting, the Slovak Red Cross Society must keep separate accounts of revenues and expenses relative to the performance of its duties under this law (Article 5 paragraph 1), revenues and expenses relative to the performance of other tasks in the public interest adopted under this law (Article 3 paragraph 2 and Article 4 paragraph 2) and the revenues and expenses relative to its business activities (Article 8).

(3) The audit of the annual financial statements shall follow the provisions of a special law. |39| The annual financial statements shall be available to the public at the seat of the Slovak Red Cross Society and shall be subject to access under a special law. |40|

Article 11
Annual report of the Slovak Red Cross Society

(1) The Slovak Red Cross Society shall process an annual report by the date determined in the statutes, following the end of a calendar year, however no later than by 30th of June.

(2) The annual report shall in particular include:

    a) review of the activities carried out during the relevant calendar year, stating the relationship to the duties of the Slovak Red Cross Society established by this law (Article 5 paragraph 1),

    b) annual financial statements and evaluation of the key data therein,

    c) auditor's opinion on the annual financial statements, if applicable,

    d) review of financial receipts and expenses,

    e) review of the scope of receipts (revenues) classified according to sources,

    f) the state and circulation of the assets and liabilities of the Slovak Red Cross Society,

    g) changes in and new structure of the bodies of the Slovak Red Cross Society that occur during the relevant year.

(3) The annual report must be published by the means determined in the statutes. For information, the Slovak Red Cross Society shall send a copy of the annual report to the government by 15th of July of the relevant calendar year.

(4) The annual report must be made available to the public at the seat of the Slovak Red Cross Society.

SECOND PART
PROTECTION OF THE RED CROSS EMBLEM AND NAME

Article 12
Use of the Red Cross emblem and name

In compliance with the Geneva Conventions and their additional amendment protocols, |41| resolutions of international Red Cross and Red Crescent Conferences and the rules of the International Committee of the Red Cross concerning the use of the Red Cross or Red Crescent emblem and name by national societies, the emblem or name of the Red Cross may only be used in times of peace and in times of war or warfare |42| within the territory of the Slovak Republic:

    a) by the Slovak Red Cross, in particular to denote the premises owned or used by the Slovak Red Cross Society and its regional organisations, facilities of the Slovak Red Cross Society as well as employees and volunteers of the Slovak Red Cross Society upon performing duties under this law (Article 5 paragraph 1),

    b) national societies of the Red Cross and their employees as well as persons acting on their behalf under the conditions established by the Geneva Conventions and their additional amendment protocols, |43|

    c) military health care facilities and military medical services, to denote and protect health care units and facilities, staff and material protected by the Geneva Conventions and their additional amendment protocols |44| and other international conventions regulating similar matters with which the Slovak Republic is bound,

    d) by the operators of vehicles designed as ambulances and by the operators of rescue stations exclusively designed for free treatment of the wounded or sick, to denote such ambulances and rescue stations; in times of peace only with the explicit consent of the Slovak Red Cross Society.

Article 13
Offence

(1) At the suit of the relevant body of the Slovak Red Cross Society, the relevant municipal body is authorized to impose a fine of SKK 100,000 on any person using the emblem or name of the Red Cross or imitating the emblem or name of the Red Cross in conflict with Article 12 of this law, or who knowingly assists in such abuse, or a fine of SKK 500,000 if concerning such action at the time of events to which the Geneva Conventions and their additional amendment protocols |45| refer.

(2) If not otherwise established by this law, offence proceedings pursuant to paragraph 1 shall follow a special regulation. |46| For dealing with matters concerning such offence, the relevant municipal body shall invite a representative of the Slovak Red Cross Society. Revenues from fines imposed pursuant to paragraph 1 shall be considered to be receipts of the municipal budget.

(3) The provisions of paragraph 1 shall not be used, if concerning an action that is classified as a criminal act. |47|

(4) The holder of an object is obliged to immediately remove the unauthorized denotation of such object with the emblem or name of the Red Cross or with an imitation of the emblem or name of the Red Cross, failing which the relevant municipal body shall at the suit of the Slovak Red Cross Society decide upon the removal of such unauthorized denotation at the holder's expense. If such unauthorized denotation cannot be removed from the object, the relevant municipal body shall impose forfeiture or confiscation of such object, even if the measure pursuant to paragraph 1 or criminal act did not occur. In such case, the Slovak Republic shall become the holder of such forfeited or confiscated object, without compensation.

THIRD PART
COMMON, TEMPORARY AND FINAL PROVISIONS

Article 14

According to this law, the distinctive visual symbols of the Red Crescent and the Red Lion with Sun shall have the same protective function as the distinctive symbol of the Red Cross. |48|

Article 15

(1) The government and the Slovak Red Cross Society shall enter into an agreement on mutual relations and cooperation between the Government of the Slovak Republic and the Slovak Red Cross Society (Article 3 paragraph 4) no later than six months after the effective date of this law.

(2) The Ministry of Defence of the Slovak Republic, ministry of interior, ministry of health and ministry of labour and the Slovak Red Cross Society shall enter into agreements under this law (Article 5 paragraph 1) no later than three months from the signature of an agreement pursuant to paragraph 1.

(3) The Slovak Red Cross Society is obliged to obtain accreditation for carrying out first aid training and instruction of the population no later than by 31st December 2008. First aid training and instruction of the population until the above-mentioned date shall follow the present legal regulations.

Article 16

Any offence proceedings commenced prior to the effective date of this law shall be completed under the present regulations.

Article 17

Act of the National Council of the Slovak Republic No. 84/1994 Coll. on the Slovak Red Cross Society and on the Protection of the Emblem and Name of the Red Cross shall hereby be repealed.

2. The footnote to reference 1c shall read:

    "1c) Article 5 paragraph 1 of Act No. 460/2007 Coll. on the Slovak Red Cross and on the protection of the emblem and name of the Red Cross and on the amendments of certain Laws."

Section III

Act No. 582/2004 Coll. on local taxes and local charges for communal waste and small construction waste as amended by Act No. 733/2004 Coll., Act No. 747/2004 Coll., Act No. 171/2005 Coll., Act No. 517/2005 Coll. and Act No. 120/2006 Coll. shall be amended as follows:

In Article 17, paragraph 1 shall be supplemented with letter d), which shall read:

    "d) lands, constructions and non-residential premises owned by the Slovak Red Cross Society".

Section IV

This law shall enter into force on 1 January 2008.
