Decision on the Establishment and Activities of the Permanent Coordination Group for International Humanitarian Law

On the basis of Article 40 of the Decree on the Internal Organisation, Job Classification, Posts and Titles in Public Administration and Justice Bodies (Official Gazette of the Republic of Slovenia Nos. 58/03, 81/03, 109/03, 43/04 (58/04 - corr.), 138/04, 35/05, 60/05, 72/05, 112/05, 49/06, 140/06, 9/07, 101/07, 33/08, 66/08, 88/08, 8/09, 63/09, 73/09, 11/10, 42/10, 82/10, 17/11, 14/12, 17/12, and 23/12), the Government of the Republic of Slovenia adopted, at its 51st regular session on 27 March 2014, under item II/6.11, the following

DECISION
on the Establishment and Activities of the Permanent Coordination Group for International Humanitarian Law

Article 1
(Establishment)

This Decision establishes the Permanent Coordination Group for International Humanitarian Law (hereinafter: the Group) and regulates its activities.

Article 2
(Tasks)

The Group monitors, fosters, shapes, coordinates, and oversees activities concerning the implementation of, and respect for, international humanitarian law by the Republic of Slovenia, provides opinions on international humanitarian law issues and strives to broaden the knowledge and expertise on international humanitarian law at the national level.

The Group focuses on the implementation of commitments under treaties on international humanitarian law, to which the Republic of Slovenia is a party, particularly the 1949 Geneva conventions and their Additional Protocols.

The Group proposes the relevant line ministries to ratify treaties on international humanitarian law, align the regulations and practice of the Republic of Slovenia with international humanitarian law and best international practices, formulates proposals and recommendations for the implementation of international humanitarian law and monitors their implementation, and discharges other tasks at the national level that concern the respect of international humanitarian law.

Article 3
(Leadership and membership of the group)

(1) The Group is composed of:

    - A representative of the ministry responsible for foreign affairs, who chairs the Group;

    - A representative of the ministry responsible for defence;

    - A representative of the ministry responsible for the interior;

    - A representative of the ministry responsible for education;

    - A representative of the ministry responsible for culture;

    - A representative of the ministry responsible for labour, family and social affairs;

    - A representative of the ministry responsible for the environment;

    - A representative of the ministry responsible for health;

    - A representative of the ministry responsible for justice;

    - A representative of the General Staff of the Slovenian Armed Forces;

    - A representative of the Slovenian Administration for Civil Protection and Disaster Relief;

    - A representative of the ministry responsible for foreign affairs, who is the Secretary of the Group.

(2) Representatives of the Slovenian Red Cross, the Slovenian National Education Institute and the Faculty of Law of Ljubljana are invited to attend the sessions of the Group; if necessary, the sessions are also attended by representatives of other expert institutions and organisations.

Article 4
(Plan of work and reporting)

(1) The Group draws up a plan of work.

(2) The Group reports about its activities every two years to the Government of the Republic of Slovenia.

Article 5
(Organisation of work)

(1) The Group holds regular session convened by its Chair, at least twice a year.

(2) The Group may set up sub-groups to address particular issues.

(3) If the circumstances permit or dictate, a certain issue may also be addressed by correspondence.

(3) Minutes are drafted on each session and distributed to all participants.

Article 6
(Costs)

The administrative and technical support to the Group is provided by the Ministry of Foreign Affairs. Each authority or institution covers all costs relating to the participation at the Group sessions or its work for their own representatives.

Article 7
(Application of provisions mutatis mutandis)

The Rules of Procedure of the Government of the Republic of Slovenia apply to the work of the Group, unless otherwise stipulated by this Decision.

Article 8
(Transitional and final provisions)

(1) The Group continues the work of the Interministerial Commission on International Humanitarian Law, which was established by Decision of the Government of the Republic of Slovenia No. 762-01/99-1 (B) of 1 April 1999 and discontinued by Decision of the Government of the Republic of Slovenia No. 01100-1/2012/43 of 24 May 2012. The Group takes over the archives of the Interministerial Commission on International Humanitarian Law.

(2) This Decision takes effect after its adoption.
