Red Cross Act, BE. 2499


BHUMIBOL ADULYADEJ, REX.

Given on the 1st August, B.E. 2499
Being the the 11th Year of the Present Reign.

His Majesty King Bhumibol Adulyadej has been graciously pleased to proclaim that:

Whereas Thailand is a party to the Geneva Convention for the Amelioration of the Condition of the Wounded and Sick in Armed Forces in the Field dated 12th August, B.E. 2492, and to the Geneva Convention for the Amelioration of the Condition of the Wounded, Sick and Shipwrecked Members of Armed Forces at Sea dated 12th August, B.E. 2492;

And whereas it is expedient to enact an Act so as to be in conformity with the provisions of the said Conventions;

Be it, therefore, enacted by the King, by and with the advice and consent of the Assembly of the People's Representatives, as follows:

Section 1. This Act shall be called the "Red Cross Act, BE. 2499."

Section 2. This Act shall come into force as and from the day following the date of its publication in the Government Gazette.

Section 3. The Red Cross Act, B.E. 2481, the Red Cross Act (No. 2 , B.E. 2485, and all other laws, bye-laws and regulations in so far as they are provided for in this Act, or are contrary to or inconsistent with the provisions of this Act shall be repealed, and this Act shall apply.

Section 4. In this Act:

"Conventions" means the "Geneva Convention for the Amelioration of the Condition of the Wounded and Sick in Armed Forces in the Field dated 12th August, B.E. 2492" and the "Geneva Convention for the Amelioration of the Condition of the Wounded, Sick and Shipwrecked Members of Armed Forces at Sea dated 12th August, B.E. 2492", as the case may be;

"Red Cross emblem" means the red cross on a white ground;

"Red Cross name" means the wording "Red Cross" or "Geneva Cross."

Section 5. The Red Cross emblem shall be used as emblem of the medical services in the Thai Armed Forces.

The emblem shall be displayed on the flags, armlets and on all equipments used in the medical services as may be ordered by the competent military authority.

Section 6. The Thai Red Cross Society shall use the Red Cross emblem in peace-time according to the law on Thai Red Cross Society.

Section 7. The use of the Red Cross emblem in peace-time in order to manifest that the conveyance is used as an ambulance and in order to designate the site of a health station particularly used for treatment of the wounded or sick without charge may be made when special permission has been obtained from the Thai Red Cross Society according to the conditions determined by the Minister of Public Health.

Section 8. The Thai Red Cross Society shall be under the control of the Minister of Public Health, except in the matter of ordinary businesses which must be carried out according to the regulations and rules of the International Committee of the Red Cross and of the League of Red Cross Societies.

Section 9. Whoever, without being entitled according to the Conventions or this Act, uses the Red Cross emblem or the Red Cross name shall be punished with imprisonment not exceeding three months or fine not exceeding one thousand baht, or both.

Section 10. Whoever uses any emblem or wording imitating the Red Cross emblem or the Red Cross name, or resembling such emblem or name as may be inferred that it is so done in order to deceive the public, shall be punished with imprisonment not exceeding three months or fine not exceeding one thousand baht, or both.

Section 11. Whoever committing offence as specified in Section 9 or 10 for the purpose of acquiring money or any commercial undertaking affixes the Red Cross emblem or the Red Cross name on the merchandise for sale, such as, label or trade mark, shall be punished with imprisonment not exceeding six months or fine not exceeding two thousand baht.

Section 12. Section 9, 10 or 11 shall apply to the emblem of the red crescent on a white ground or of the red lion and sun on a white ground, and to the name ''red crescent" or "red lion and sun", mutatis mutandis.

Section 13. Whoever uses the Great Seal of the Swiss Confederation or uses any emblem imitating or resembling or similar to the Great Seal of the Swiss Confederation in violation of the Conventions, shall be punished as specified in Section 9, 10, 11, or 12, as the case may be.

Section 14. All illegitimate emblems or names specified in Section 9, 10, 11, 12 or 13, the money collected as well as merchandises or other movable properties, containers or packages on which are affixed such emblems or names, may be forfeited by the Court.

Section 15. The Minister of Public Health shall take charge and control of the execution of this Act, and shall have the power to issue Ministerial Regulations for carrying out this Act.

Such Ministerial Regulations shall come into force upon their publication in the Government Gazette.
