Crime of Aggression

The crime of aggression is provided for under Articles 796-799 (Book V "War Crimes, Crimes of Aggression and Crimes of Mercenaries", Title I "War Crimes and Crimes of Aggression", Chapter II "Crimes of Aggression") of the 2016 Criminal Code of the Republic of Guinea. See:

    Crimes Against Humanity

    Crimes against humanity are defined in Articles 194 and 195 (Book II "Crimes and Offences against the People", Title I "Crimes against Groups of People and against Humankind", Chapter II "Crimes against Humanity") of the 2016 Criminal Code of the Republic of Guinea. See:

    Genocide

    Genocide is defined in Articles 192 and 193 (Book II "Crimes and Offences against the People", Title I "Crimes against Groups of People and Against Humankind", Chapter I "Genocide") of the 2016 Criminal Code of the Republic of Guinea. See:

    War Crimes

    War crimes are defined in Articles 787-795 (Book V "War Crimes, Crimes of Aggression and Crimes of Mercenaries", Title I "War Crimes and Crimes of Aggression", Chapter I "War Crimes") of the 2016 Criminal Code of the Republic of Guinea. Additionally, Article 681 of the Criminal Code punishes, inter alia, the misuse of the distinctive emblems of the Geneva Conventions. See:

    Jurisdiction

    Jurisdiction: The territorial and extraterritorial jurisdictional regime of the Criminal Code of Guinea is described in Articles 9-13 thereof.

    Common provisions:

  • Non-applicability of statutory limitations for all crimes under Title I: Article 800 of the Criminal Code.
  • Due obedience to manifestly illegal orders does not exempt subordinates from criminal repsonsibility: Article 801 of the Criminal Code.
  • Command responsibility: Article 197 of the Criminal Code.
  • Responsibility of officials: Article 199 of the Criminal Code.
  • Responsibility of legal persons: Articles 200-201 of the Criminal Code.
