Crime of Aggression / Crimes against Peace

Article 2 of the Italian law implementing the Rome Statute of the International Criminal Court states that "Full and complete execution shall be given to the Statute referred to in Article 1 [the Rome Statute of the International Criminal Court], as from the date of its entry into force, in accordance with Article 126 of the Statute". The crime of aggression is included in Article 5 of the Rome Statute among the crimes within the jurisdiction of the Court. (As of 01Sep17, Italy has not ratified the Kampala amendments on the Crime of Aggression, by which the definition of the crime of aggression was included in the Rome Statute). See:

    Crimes Against Humanity

    Article 2 of the Italian law implementing the Rome Statute of the International Criminal Court states that "Full and complete execution shall be given to the Statute referred to in Article 1 [the Rome Statute of the International Criminal Court], as from the date of its entry into force, in accordance with Article 126 of the Statute". Crimes against Humanity are defined in Article 7 of the Rome Statute among the crimes within the jurisdiction of the Court. See:

    Additionally, the Republic of Italy acceded to the International Convention for the Protection of all Persons from Enforced Disappearance on 8 October 2015. Article 5 of this Convention states that "[T]he widespread or systematic practice of enforced disappearance constitutes a crime against humanity as defined in applicable international law and shall attract the consequences provided for under such applicable international law."

    Genocide

    Genocide is defined in Articles 1-2 and 4-6 of the Law No. 962 on the Prevention and Punishment of the Crime of Genocide of 09 October 1967. See:

    War Crimes

    International Criminal Court

    Rome Statute of the International Criminal Court: The Republic of Italy signed the Rome Statute of the International Criminal Court on 18 July 1998 and deposited its instrument of ratification on 26 July 1999.

    On 28 April 2004 the Republic of Italy made the following notification under article 87 (1) and (2) of the Rome Statute of the International Criminal Court:
      “Italy hereby specifies that it would like to receive the requests for cooperation provided for by Article 87 of the Rome Statute through diplomatic channels. The language in which those requests and the relevant documents should be received is Italian, together with a French translation.”
