    Jurisdiction

    In particular, Article 646 declares that the courts of Benin enjoy jurisdiction over the offences proscribed by international treaties and conventions to which Benin is a state party in conformity with the mandatory rules on jurisdiction set out in the said treaties and conventions.

    In addition, Article 147 of the Constitution of the Republic of Benin states:

      "Treaties or agreements lawfully ratified shall have, upon their publication, an authority superior to that of laws, without prejudice for each agreement or treaty in its application by the other party."
    (Benin ratified the Rome Statute of the International Criminal Court on 22 January 2002 and, inter alia, is a State party to the four Geneva Conventions of 1949, their two Additional Protocols of 1977, the Convention on the Rights of the Child of 1989 and the Optional Protocol on the involvement of children in armed conflict of 2000).
