The Republic of Haiti is in the process of adopting a new Criminal Code since 2014. Crimes against humanity are provided for under Articles 230-232 of the draft law of the new Criminal Code. Common provisions to crimes against humanity are included in Articles 233-240 of the Draft Criminal Code. Genocide

No provision.

The Republic of Haiti is in the process of adopting a new Criminal Code since 2014. Genocide is provided for under Articles 228 and 229 of the draft law of the new Criminal Code. Under article 229 genocide is considered a crime against humanity. Common provisions to crimes against humanity, including genocide, are included in Articles 233-240 of the Draft Criminal Code.     General comment regarding the legal effect of international treaties

    Article 276-2 of the Constitution of Haiti (1987) provides:
      "Once international treaties or agreements are approved and ratified in the manner stipulated by the Constitution, they become part of the legislation of the country and abrogate any laws in conflict with them."
    Haiti is a state party, inter alia, to the Geneva Conventions of 1949, the Additional Protocols to the Geneva Conventions and the Convention on the Prevention and Punishment of Genocide. Haiti also adhered to the Agreement for the Prosecution and Punishment of the Major War Criminals of the European Axis. Signed at London, on 8 August 1945, which contains the Charter of the Nuremberg International Military Tribunal as an annex and which came into force for Haiti on 3 November 1945.


    International Criminal Court

    Rome Statute of the International Criminal Court: The Republic of Haiti signed the Rome Statute of the International Criminal Court on 26 February 1999. The Republic of Haiti is not a state party to the Rome Statute of the Internatational Criminal Court.
