Domestic legislation for serious crimes under international law

Crime of Aggression

No specific provision.

Article 79 of the Criminal Code (17 juin 1972) provides the following regarding the recruitment of foreign soldiers in times of peace:

    Art. 79 - Sera coupable d’atteinte à la sûreté extérieure de l’Etat et puni des peines portées à l’article 83, tout Malgache ou tout étranger :
    1° Qui aura, par des actes hostiles non approuvés par le Gouvernement, exposé Madagascar à une déclaration de guerre ;
    2° Qui aura, par des actes hostiles non approuvés par le Gouvernement, exposé des Malgaches à subir des représailles ;
    3° Qui, en temps de paix, enrôlera des soldats pour le compte d’une puissance étrangère, en territoire malgache ;
    4° Qui, en temps de guerre, entretiendra, sans autorisation du Gouvernement, une correspondance ou des relations avec les sujets ou les agents d’une puissance ennemie ;
    5° Qui, en temps de guerre, au mépris des prohibitions édictées, fera, directement ou par intermédiaire, des actes de commerce avec les sujets ou les agents d’une puissance ennemie..

Crimes Against Humanity

No specific provision.

Article 137 of the Constitution of the Fourth Republic of Madagascar (11 December 2010) provides that "The treaties or agreements regularly ratified or approved have, from their publication, an authority superior to that of the laws, under reserve, for each agreement or treaty, of its application by the other party." Madagascar has signed (06 February 2007), although not ratified, the International Convention for the Protection of all Persons from Enforced Disappearance, whose Article 5 states: "The widespread or systematic practice of enforced disappearance constitutes a crime against humanity as defined in applicable international law and shall attract the consequences provided for under such applicable international law."

War Crimes

Article 91 of the Criminal Code of 1972 includes some war crimes in situations of non-international armed conflict:

    Art. 91 - L’attentat dont le but sera, soit d’exciter à la guerre civile en armant ou en portant les citoyens ou habitants à s’armer les uns contre les autres, soit de porter la dévastation, le massacre et le pillage dans une ou plusieurs communes, sera puni de mort.
    Le complot ayant pour but l’un des crimes pr évus au présent article, et la proposition de former ce complot, seront punis des peines portées en l’article 89, suivant les distinctions qui y sont établies.
    Les autres manoeuvres et actes de nature à compromettre la s écurité publique ou à occasionner des troubles politiques graves, à provoquer la haine du Gouvernement malgache, à enfreindre les lois du pays, seront déférés aux tribunaux correctionnels et punis d’un emprisonnement d’un an au moins et de cinq ans au plus. Les coupables pourront, en outre, être interdits, en tout ou en partie, des droits mentionnés en l’article 42, pendant cinq ans au moins et dix ans au plus, à compter du jour o ù ils auront subi leur peine. L’interdiction de séjour pourra aussi être prononcée contre eux pendant le même nombre d’années.

Madagascar is a state party to the main International Humanitarian Law conventions and treaties, including the 1949 Geneva Conventions; their 1977 Additional Protocols; the Geneva Protocol on Asphyxiating or Poisonous Gases, and of Bacteriological Methods, 1925; the Convention on the Prohibition of Biological Weapons, 1972; the Convention prohibiting Chemical Weapons, 1993 or the Convention on Cluster Munitions, 2008.     Jurisdiction

    Extraterritorial jurisdiction is provided for under Title II of the Criminal Procedure Code of 1962 of Madagascar:

      Art. 507. - Tout citoyen malgache qui, en dehors du territoire de Madagascar, s'est rendu coupable d'un fait qualifié crime puni par la loi malgache, peut être poursuivi et jugé par les juridictions malgaches.
      Tout citoyen malgache qui, en dehors du territoire de Madagascar, s'est rendu coupable d'un fait qualifié délit par la loi malgache, peut être poursuivi et jugé par les juridictions malgaches si le fait est puni par la législation du pays où il a été commis.
      Les délits d'atteinte à la sûreté de I'Etat et de contrefaçon du sceau de l'Etat ou des monnaies nationales ayant cours à Madagascar, commis en dehors du territoire malgache sont punissables comme les délits commis sur ce territoire.
      Les dispositions du présent article sont applicables au délinquant qui n'a acquis la nationalité malgache que postérieurement au fait qui lui est imputée.

    International Criminal Court

    Rome Statute of the International Criminal Court: The Republic of Madagascar signed the Rome Statute of the International Criminal Court on 18 July 1998 and deposited its instrument of ratification on 14 March 2008.
