Crimes Against Humanity

➤ Crimes against Humanity are defined in Title II, Chapter I ("On the Crime of Genocide, War Crimes, Crimes against Humanity and the Crime of Apartheid"), Sections 3 and 4, Articles 149-154 of the Criminal Code of the Togolese Republic of 24 November 2015 (in force since 25 November 2015). See:

    ➤ Additionally, the Togolese Republic ratified the Convention for the Protection of all Persons from Enforced Disappearance (2006) on 21 July 2014. Article 5 of the said Convention stipulates:
      "The widespread or systematic practice of enforced disappearance constitutes a crime against humanity as defined in applicable international law and shall attract the consequences provided for under such applicable international law."
    Article 50 of the Togolese Constitution provides:
      "Article 50
      The rights and duties, stated in the Universal Declaration of the Rights of Man and in the international instruments relative to the Rights of Man, ratified by Togo, are an integral part of this Constitution."

    Genocide

    Genocide is included in Title II, Chapter I ("On the Crime of Genocide, War Crimes, Crimes against Humanity and the Crime of Apartheid"), Section 1, Articles 143 and 144 of the Criminal Code of the Togolese Republic of 24 November 2015 (in force since 25 November 2015). See:

    War Crimes

    War crimes are included in Title II, Chapter I ("On the Crime of Genocide, War Crimes, Crimes against Humanity and the Crime of Apartheid"), Section 2, Articles 145-148 of the Criminal Code of the Togolese Republic of 24 November 2015 (in force since 25 November 2015). See:

    In addition, Articles 560-565 of the Criminal Code are devoted to bacteriological and chemical weapons and Articles 649-653 to mercenarism.

    Jurisdiction:

    Title I, Chapter 1, Section 2, Articles 6-10 of the Criminal Code of 24 November 2015 concerns the territorial application of the criminal law.

    Non-Applicability of Statutory Limitations and other common provisions to crimes against humanity, genocide, war crimes and the crime of apartheid:

  • Article 155: Jurisdiction.
  • Article 156: Responsibility of public officials and members of the Government and Parliament.
  • Article 157: Command responsibility.
  • Article 158: Penalties (natural persons).
  • Article 159: Penalties (legal persons).
  • Article 160: Obedience to illegal orders.
  • Article 161: Exonerating circumstances.
  • Article 162: Participation in defensive operations.
  • Article 163: Penalties in the case of concurrent offences.
  • Articles 164: The crime of genocide, war crimes, crimes against humanity and the crime of apartheid are not subject to any statute of limitations.
