New York City Bar Association Statement on the Threat of Use of Force Against Iran
The New York City Bar Association condemns, in the strongest possible terms, the ongoing threats by President Donald J. Trump to use armed force against Iran without legal authority. This unprovoked use of military force violates both the Constitution, which reserves to Congress the power to declare war, and the War Powers Act of 1973, which makes clear that the President may not authorize military actions, except "in a national emergency created by attack upon the United States, its territories or possessions, or its armed forces," without "specific statutory authorization." None of those conditions are satisfied here.
The President's threatened actions also violate the United Nations Charter, a binding treaty. Article 2(4) prohibits the threat or use of force against the territorial integrity or political independence of any state without its consent, a valid claim of self-defense, or authorization by the Security Council. Neither are any of those conditions satisfied.
President Trump's continued threats and use of armed force against various states, including Iran, violate both U.S. and international laws and norms that for 80 years have delivered to the American people unprecedented security and prosperity. The New York City Bar Association urges Congress to fulfill its Constitutional duties and exercise its authority to restrain this unlawful use of force and uphold respect for the laws that have done so much to preserve us from the dangers of a chaotic world.
